If a landlord has the correct waste separation checked by a service provider, he can pass on the costs for this to the tenants. This emerges from a judgment of the Federal Court of Justice (BGH) published on Tuesday. Tenants from Berlin who were supposed to pay a little more than twelve euros for this “container management” in 2018 had complained. The service provider was commissioned to regularly check the residual waste bins in the facility with around 100 apartments and to sort out incorrectly thrown in waste by hand if necessary. According to the BGH, this service falls under “waste disposal” – and the costs for this may be passed on to the tenants according to the Operating Costs Ordinance.
